SEC releases statement: PoS Blockchain staking activities do not constitute securities trading.

Gate News bot message, the SEC’s Division of Corporation Finance recently issued a statement clarifying its regulatory stance on staking activities on attestation Blockchain networks. The statement indicated that protocol staking activities conducted on public, permissionless PoS Blockchain networks do not constitute securities transactions. This regulation applies to individual stakers and institutions providing non-custodial or custodial staking services.

The SEC further clarified that even if staking services include features such as risk reduction guarantees, early unlocking, reward payments, or asset aggregation, they do not automatically constitute a securities offering. This statement provides clear regulatory guidance for participants in staking to engage in network consensus mechanisms.
